Job Description

MINIMUM QUALIFICATIONS:

Education

  • A Bachelor's Degree in business administration, engineering, or a related field.

  • Or in lieu of degree four (4) additional years of professional experience in the procurement and contracting of materials, equipment and service contracts.

Experience

  • Nine (9) years of professional experience in the procurement and contracting of materials, equipment and service contracts. This must include at least three (3) years’ experience leading, supervising or managing staff in any business function/department. Experience in government transit agency procurement and FTA funded procurements preferred.

Certification/Licensure

  • Must obtain a certification from an accredited procurement program; the National Contract Management Association (NCMA), the Certified Professional Contracts Manager (CPCM) or an appropriate certificate from a program sponsored by the National Institute of Government Purchasing (NIGP), the Federal Acquisition Institute (FAI), the Defense Acquisition University (DAU), or the Defense Acquisition Workforce Initiative (DAWIA) within two (2) years of hire. This certification must be maintained thereafter.

SUMMARY :

The Contract Manager is responsible for managing contract actions from formation to close-out to ensure cost effective and timely procurement of materials, equipment and services in programmatic areas designated by the Vice President & Chief Procurement Officer (VP CPO). The incumbent has contracting officer authority, as delegated by the VP CPO, with extensive workflow responsibilities, performance metric oversight and reporting by program. The Manager serves as the primary department point of contact for all procurement actions required by Program. The incumbent has extensive latitude for independent judgment and action within established guidelines.

ESSENTIAL FUNCTIONS

  • Develops, formulates, and recommends contract terms and conditions for material, equipment and service contracts. Determines the type of contract to be utilized for individual procurements and prepares the appropriate contracts. Recommends changes to improve contract terms, conditions and procedures.

  • Analyzes contractor cost proposals. Chairs, conducts, and supervises negotiations of contracts involving material, equipment, services and any modifications thereto. Reviews and recommends for approval the issuance of contract modifications. Reviews and evaluates technical and price proposals on negotiated procurements and recommends action to be taken. Serves on Contractor Evaluation Boards, as required.

  • Supervises the cost-effective contract administration of assigned contracts to ensure compliance with contract terms and conditions. In conjunction with WMATA representatives and other appropriate parties, develops the pre-negotiation position with regard to the contractor's proposal for contract closeouts, modifications, and claims, based on time and cost analyses, conferences, financial statements, audit reports, legal advice, and personal research to establish positions. Interprets and evaluates audit reports for use in contract settlements pertaining to material, equipment and services procurements.

  • Manages the contract process to service level agreements, reports on contract status and the cost effectiveness of contracts.

  • Reviews and approves contract actions within scope of approval authority. Reviews and recommends for approval/disapproval contract actions outside the scope of approval authority. Ensures proper documentation is recorded in the contract case file. Assembles complex claim files, prepares respective party's positions, prepares documentation in those instances where the negotiations do not end in bilateral modifications, and prepares the Contracting Officers’ final decisions on material equipment, supply and service, professional and technical service, construction and Architect/Engineer (A/E) procurements.

  • Coaches and counsels employees to ensure desired performance. Uses assignments and training to enhance employee skills and career development. Ensures that employees contribute and play an active role in the appraisal process. Initiates the performance plan, mid-year review and annual review to be submitted to the Procurement Manager and VP CPO or designee for approval.

  • Supervises Commodity Specialists, Contract Specialists and other personnel as assigned, to include recommending applicant selection, disciplinary actions, resolution of grievances, assigning duties, directing work, approving leave requests and time sheets, and ensuring appropriate subordinate training is provided. Actively coaches employees to continually improve employee performance and behavior.

  • Responsible for achieving procurement metrics as defined by the Contracting Officer and the VP CPO.

  • Keeps current on external laws, regulations and internal policies and procedures. Acts responsibly to identify and achieve Equal Employment Opportunity (EEO) workforce goals.

  • In coordination with the VP CPO or designee, develops presentations to the Board of Directors regarding active contracts that exceed the General Manager's approval authority.

  • Evaluates and makes recommendations to the VP CPO regarding the litigation of material, equipment, and services contract claims under the administrative appeals procedures.

  • Develops, implements, and monitors prompt payment procedures for contractor payment requests. Ensures that required documentation is maintained to support these payments.

  • Handles complex contracts beyond the scope of the Contract Administrators to include planning acquisitions; preparing solicitations; soliciting bids and offers; evaluating and negotiating contracts; conducting pre-award survey; and awarding, administering, and closing out contracts.

  • Oversees effectiveness of Contract Officer Technical Resource (COTR) management of contracts and recommends appropriate corrective action to the Contracting Officer for inefficiencies realized. Also recommends COTR retraining as deemed necessary.

OTHER FUNCTIONS

  • Attends all required training programs and applies the knowledge gained in day-to-day management activities.

  • Participates in the review and investigation of prospective contractors' ability to perform under WMATA contracts. Prepares responsibility recommendations for Contracting Officer's review and determination.
